Please read these Terms and Conditions carefully before using our website or services.
1. ACCEPTANCE OF TERMS
By accessing, browsing, or using the website located at www.callorganix.com (“Site”) or by purchasing, scheduling, or receiving any pest control services from Organix Pest Control (“Company,” “we,” “our,” or “us”), you (“Customer,” “you,” or “your”) acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions (“Terms”).
If you do not agree with any part of these Terms, you must immediately discontinue use of the Site and refrain from purchasing or receiving our services. Your continued use of the Site or services constitutes your ongoing acceptance of these Terms as they may be updated from time to time.
You represent and warrant that you are at least eighteen (18) years of age and have the legal capacity to enter into a binding agreement. If you are entering into these Terms on behalf of a business entity, you represent that you have the authority to bind that entity.
2. DESCRIPTION OF SERVICES
Organix Pest Control provides professional pest management and control services for residential and commercial properties, including but not limited to:
- General pest control treatments (interior and exterior)
- Rodent control and exclusion services
- Insect identification and targeted treatments
- One-time pest treatments and recurring service plans
- Preventative pest maintenance programs
- Property inspections and pest assessments
- Specialty treatments as offered and described on the Site
The specific scope of services for each customer will be detailed in the individual service agreement, invoice, or work order provided at the time of service. Services may vary based on property type, geographic location, pest species, severity of infestation, and other factors determined during inspection.
3. SERVICE SCHEDULING AND ACCESS
3.1 Scheduling
Service appointments may be scheduled through the Site, by telephone, or through other communication methods made available by the Company. All appointment times are estimates and may be subject to change due to weather conditions, emergency calls, equipment issues, or other unforeseen circumstances. We will make reasonable efforts to notify you of any scheduling changes in advance.
3.2 Property Access
You agree to provide our technicians with safe, clear, and reasonable access to all areas of the property requiring treatment. This includes:
- Clearing obstructions from treatment areas as instructed during scheduling
- Securing pets in a safe location away from treatment areas
- Ensuring technicians can access interior and exterior areas as needed
- Providing keys, access codes, or gate access if the service is to be performed when you are not present
If our technician is unable to access the property or the required treatment areas upon arrival, and reasonable arrangements cannot be made, you may be charged a trip fee or service call fee as outlined at the time of scheduling.
3.3 Cancellations and Rescheduling
We request that you provide at least twenty-four (24) hours’ notice for any cancellations or rescheduling requests. Repeated no-shows or last-minute cancellations may result in a cancellation fee being assessed. The specific cancellation fee amount, if applicable, will be communicated at the time of scheduling.
4. PRICING AND PAYMENT
4.1 Service Pricing
All prices for services are quoted in U.S. dollars and are subject to change without notice. The price for your specific service will be confirmed prior to the commencement of work, either through a written estimate, service agreement, or at the time of scheduling. Pricing may vary based on property size, severity of infestation, type of treatment required, and geographic location.
4.2 Payment Terms
Payment is due upon completion of services unless alternative payment arrangements have been agreed upon in writing. We accept payment via major credit cards, debit cards, checks, and other methods as displayed on the Site or communicated at the time of service.
4.3 Late Payments
Invoices not paid within thirty (30) days of the service date may be subject to a late fee of 1.5% per month (or the maximum rate permitted by applicable law, whichever is less) on the outstanding balance. The Company reserves the right to suspend or terminate services, including warranty coverage, for accounts with outstanding balances.
4.4 Recurring Service Plans
If you enroll in a recurring service plan (monthly, bi-monthly, quarterly, or otherwise), you authorize the Company to charge your designated payment method at the agreed-upon intervals. You may cancel a recurring plan by providing at least thirty (30) days’ written notice before the next scheduled service date. Early termination of a discounted plan may result in forfeiture of promotional pricing, and you may be charged the difference between the discounted rate and the standard rate for services already rendered.
5. WARRANTIES AND GUARANTEES
Certain services may include a warranty or guarantee, such as our 60-Day Pest Free Warranty. The specific terms, conditions, covered pests, exclusions, and claim procedures for any applicable warranty will be provided in a separate warranty document at the time of service. Warranty coverage is subject to the customer meeting all obligations described in the applicable warranty document.
Except as expressly provided in a separate written warranty document, all services are provided “as is” and “as available.” To the fullest extent permitted by law, the Company disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
No employee, agent, or representative of the Company is authorized to make any warranty or guarantee on behalf of the Company that is not expressly set forth in writing.
6. LIMITATION OF LIABILITY
To the maximum extent permitted by applicable law, Organix Pest Control, its owners, officers, employees, agents, and contractors shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising from or related to the use of the Site, the provision of services, or these Terms, regardless of the theory of liability.
This limitation includes, without limitation, damages for property damage beyond the treated area, loss of profits, loss of use, business interruption, personal injury not caused by our gross negligence, emotional distress, temporary relocation costs, damage to personal property not directly resulting from our negligence, and any other pecuniary loss.
In no event shall the total aggregate liability of Organix Pest Control for any and all claims arising under or related to these Terms or any service provided exceed the total amount paid by you for the specific service giving rise to the claim.
Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, the Company’s liability shall be limited to the greatest extent permitted by law.
7. CUSTOMER RESPONSIBILITIES
As a customer of Organix Pest Control, you agree to:
- Provide accurate and complete information about your property, pest issues, and any known allergies, sensitivities, or health conditions that may be relevant to the treatment
- Disclose the presence of children, pregnant individuals, elderly persons, or immunocompromised individuals residing at or frequenting the property
- Inform us of any pets, aquariums, terrariums, or livestock on the property
- Follow all pre-treatment and post-treatment instructions provided by our technicians, including vacating the premises for the recommended time if required
- Maintain reasonable sanitation and housekeeping practices that support the effectiveness of treatments
- Notify us promptly of any adverse reactions, property damage, or concerns related to our services
- Refrain from applying over-the-counter pest control products in treated areas unless authorized by our technicians
- Ensure that all information provided during scheduling, on service agreements, and on the Site is truthful and accurate
8. HEALTH AND SAFETY
Our technicians are trained and licensed professionals who use products in accordance with label directions and applicable regulations. However, pest control treatments involve the application of chemicals and products that may pose risks if not handled properly.
- You acknowledge that pest control products may cause adverse reactions in sensitive individuals, including those with allergies, asthma, chemical sensitivities, or other health conditions
- It is your responsibility to inform us of any health conditions or sensitivities prior to treatment
- You agree to follow all safety instructions, including vacating treated areas for the recommended duration and ventilating the property as directed
- You are responsible for ensuring that children, pets, and other occupants do not enter treated areas until cleared by the technician
- Safety Data Sheets (SDS) for products used in your treatment are available upon request
If you or anyone at the property experiences an adverse reaction to a pest control treatment, seek medical attention immediately and contact our office as soon as possible.
9. INTELLECTUAL PROPERTY
All content on the Site, including but not limited to text, graphics, logos, images, photographs, videos, audio clips, software, and the overall design and layout of the Site, is the property of Organix Pest Control or its content suppliers and is protected by United States and international copyright, trademark, and other intellectual property laws.
The Organix Pest Control name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of the Company. You may not use such marks without the prior written permission of the Company.
You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any material on the Site without the express prior written consent of the Company, except as follows:
- Your computer or device may temporarily store copies of such materials incidental to your accessing and viewing those materials
- You may print or download one copy of a reasonable number of pages of the Site for your own personal, non-commercial use
10. WEBSITE USE AND CONDUCT
You agree to use the Site only for lawful purposes and in accordance with these Terms. You agree not to:
- Use the Site in any way that violates any applicable federal, state, local, or international law or regulation
- Impersonate or attempt to impersonate the Company, a Company employee, another user, or any other person or entity
- Engage in any conduct that restricts or inhibits anyone’s use or enjoyment of the Site
- Use any robot, spider, scraper, or other automated means to access the Site for any purpose without our express written permission
- Introduce any viruses, Trojan horses, worms, logic bombs, or other material that is malicious or technologically harmful
- Attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of the Site, the server on which the Site is stored, or any server, computer, or database connected to the Site
- Use the Site to transmit or procure the sending of any advertising or promotional material, including “junk mail,” “chain letters,” “spam,” or any other similar solicitation
11. PRIVACY POLICY
Your use of the Site and our services is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Site or our services, you consent to the collection, use, and sharing of your information as described in our Privacy Policy.
We collect personal information necessary to provide our services, including but not limited to your name, address, phone number, email address, payment information, and property details. We use this information to schedule and perform services, communicate with you, process payments, and improve our services.
We do not sell your personal information to third parties. We may share your information with trusted service providers who assist us in operating our business, processing payments, or communicating with you, and only to the extent necessary to perform those functions.
You have the right to request access to, correction of, or deletion of your personal information, subject to applicable legal requirements. To make such a request, please contact us using the information provided in Section 18 of these Terms.
12. ONLINE REVIEWS AND TESTIMONIALS
We value customer feedback and may display testimonials and reviews on the Site. By submitting a review or testimonial, you grant Organix Pest Control a non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, and distribute your review in any media.
You represent that any review you submit is based on your genuine experience, is accurate to the best of your knowledge, does not contain defamatory or unlawful content, and does not infringe on the rights of any third party. We reserve the right to remove or edit reviews that violate these standards.
13. THIRD-PARTY LINKS
The Site may contain links to third-party websites, services, or resources that are not owned or controlled by Organix Pest Control. We provide these links for convenience only and do not endorse, warrant, or assume responsibility for the content, products, services, or practices of any third-party websites.
You acknowledge and agree that Organix Pest Control shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of any content, goods, or services available on or through any third-party websites.
14. INDEMNIFICATION
You agree to indemnify, defend, and hold harmless Organix Pest Control, its owners, officers, directors, employees, agents, contractors, licensors, and service providers from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, expenses, and fees (including reasonable attorneys’ fees) arising out of or relating to:
- Your violation of these Terms
- Your use of the Site or services, including but not limited to any use of content or services other than as expressly authorized in these Terms
- Your violation of any rights of a third party
- Any information or content you provide to the Company that is inaccurate, incomplete, or misleading
- Your failure to comply with pre-treatment or post-treatment instructions
15. FORCE MAJEURE
Organix Pest Control shall not be liable for any delay or failure to perform its obligations under these Terms if such delay or failure results from circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, severe weather events, pandemics, epidemics, government actions or restrictions, labor disputes, supply chain disruptions, civil unrest, war, terrorism, power outages, internet or telecommunications failures, or any other event beyond our reasonable control.
16. DISPUTE RESOLUTION
16.1 Informal Resolution
Before initiating any formal dispute resolution proceeding, you agree to first contact Organix Pest Control and attempt to resolve the dispute informally. You may contact us using the information in Section 18. We will attempt to resolve the dispute through good faith negotiation within thirty (30) days of receiving your notice.
16.2 Binding Arbitration
If the dispute cannot be resolved informally, you and Organix Pest Control agree that any dispute, claim, or controversy arising out of or relating to these Terms, the Site, or our services shall be resolved through binding arbitration conducted in accordance with the rules of the American Arbitration Association. The arbitration shall be conducted in the jurisdiction where the service was performed or, if no service was performed, the jurisdiction where the Company’s principal office is located.
16.3 Class Action Waiver
You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration against Organix Pest Control.
16.4 Small Claims Exception
Notwithstanding the foregoing, either party may bring an individual action in small claims court for disputes within the jurisdictional limits of that court.
17. GENERAL PROVISIONS
17.1 Modifications to Terms
We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting on the Site. Your continued use of the Site or services after any modifications constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.
17.2 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the state in which the service was performed, without regard to conflict of law principles.
17.3 Severability
If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if modification is not possible, shall be severed from these Terms. The invalidity of any provision shall not affect the validity or enforceability of the remaining provisions.
17.4 Waiver
No waiver by Organix Pest Control of any term or condition set out in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition. Any failure to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.
17.5 Entire Agreement
These Terms, together with our Privacy Policy, any applicable warranty documents, and any individual service agreements, constitute the entire agreement between you and Organix Pest Control regarding the use of the Site and our services. These Terms supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral.
17.6 Assignment
You may not assign or transfer these Terms or any rights or obligations hereunder without the prior written consent of Organix Pest Control. The Company may freely assign these Terms without restriction. These Terms will be binding upon and inure to the benefit of the parties, their successors, and permitted assigns.
17.7 No Agency
Nothing in these Terms creates any agency, partnership, joint venture, or employment relationship between you and Organix Pest Control. Neither party has the authority to bind the other or incur obligations on the other’s behalf.
