1. WARRANTY OVERVIEW

Organix Pest Control (“Company,” “we,” “our,” or “us”) stands behind the quality of our pest control services. This 60-Day Pest Free Warranty (“Warranty”) is provided to the original customer (“Customer,” “you,” or “your”) who has purchased a qualifying pest control service from Organix Pest Control and whose property has been treated at the address specified on the service invoice.

This Warranty guarantees that your treated property will remain free from the specific pests identified in your service agreement for a period of sixty (60) calendar days from the date of the initial completed treatment (“Warranty Period”). If covered pests return within this period, we will re-treat the affected areas at no additional cost to you, subject to the terms and conditions outlined herein.


2. WARRANTY PERIOD

The Warranty Period begins on the date the initial service treatment is completed as documented on your service invoice or work order. The Warranty Period expires at 11:59 PM local time on the sixtieth (60th) calendar day following the treatment date.


Example:

If your treatment is completed on January 15, your Warranty Period runs through March 16.


3. COVERED PESTS

This Warranty covers the re-treatment of the following common household pests when they were specifically targeted in your original service treatment:


Pest Category

Ants (all species)

Cockroaches (all species)

Spiders (common household)

Silverfish

Earwigs

Centipedes and Millipedes

Crickets

Pill Bugs / Sow Bugs

Fleas (interior treatments)

Wasps and Yellow Jackets (exterior nests)

Mice (interior)

Rats (interior)


Coverage applies only to those pests specifically identified and treated during your service visit. If a pest species was not targeted in the original treatment, it is not covered under this Warranty.


4. WARRANTY COVERAGE DETAILS

4.1 What Is Covered

  • Re-treatment of the originally treated areas for the same pest species identified in your service agreement
  • Labor and materials required for the re-treatment service
  • Re-inspection of the treated property to assess the nature and extent of the recurrence
  • Application of additional or alternative treatment methods as deemed necessary by our licensed technicians


4.2 Warranty Claim Process

To make a claim under this Warranty, you must:

  1. Contact Organix Pest Control within the 60-day Warranty Period by calling our office or submitting a service request through www.callorganix.com
  2. Provide your original service invoice number or customer account number
  3. Describe the nature of the pest recurrence, including the type of pest observed, the location(s) within the property, and the approximate date the activity was first noticed
  4. Allow our technician reasonable access to the property for inspection and re-treatment during normal business hours, or as mutually agreed upon


We will make every reasonable effort to schedule your re-treatment within 48 to 72 business hours of receiving your warranty claim, subject to scheduling availability.



5. EXCLUSIONS AND LIMITATIONS

This Warranty does not cover and shall not apply to the following:


5.1 Excluded Pests

  • Termites and other wood-destroying organisms (WDO) — these require separate specialized treatment agreements
  • Bed bugs — covered under a separate bed bug treatment warranty if applicable
  • Wildlife including but not limited to raccoons, squirrels, opossums, bats, birds, and snakes
  • Mosquitoes (outdoor populations)
  • Carpenter ants and carpenter bees when structural damage is involved
  • Any pest species not specifically identified and treated in the original service


5.2 Excluded Conditions

  • Pest activity resulting from new construction, renovation, or structural modifications made to the property after the original treatment date
  • Infestations caused by conditions introduced after the treatment, such as bringing in infested furniture, appliances, firewood, or other materials
  • Properties where the customer has failed to follow the pre-treatment and post-treatment instructions provided by the technician at the time of service
  • Pest recurrence attributable to extreme or unusual weather events, natural disasters, flooding, or other acts of nature
  • Properties where sanitation or housekeeping conditions create an environment conducive to pest activity, including but not limited to: excessive clutter, improper food storage, standing water, or failure to address moisture issues
  • Properties with ongoing structural deficiencies that allow pest entry, including but not limited to: unsealed gaps around pipes, broken window screens, damaged weatherstripping, open vents, or foundation cracks, where the customer has been advised of necessary repairs and has not completed them
  • Areas of the property that were not included in the original treatment scope
  • Multi-unit dwellings where adjacent or connected units are untreated and serve as a source of reinfestation
  • Properties where another pest control company has applied treatments after our service that may interfere with or compromise the effectiveness of our products


5.3 Customer Responsibilities

To maintain the validity of this Warranty, the Customer agrees to:

  • Follow all pre-treatment and post-treatment preparation instructions provided by the Organix Pest Control technician
  • Maintain reasonable sanitation and housekeeping standards throughout the property
  • Promptly report any pest activity observed during the Warranty Period
  • Provide timely and reasonable access to the property for any warranty inspections or re-treatments
  • Refrain from applying over-the-counter pest control products to the treated areas, as such products may compromise the effectiveness of professional treatments
  • Address any structural repairs or maintenance items identified by our technician as contributing to pest entry or harboring conditions



6. RE-TREATMENT TERMS

If a valid warranty claim is submitted and approved:


  1. Our licensed technician will conduct a thorough inspection of the affected areas to confirm pest activity and determine the source and scope of the recurrence.
  2. If the recurrence falls within the scope of this Warranty, we will perform a re-treatment of the affected areas using the same or alternative methods appropriate to address the issue.
  3. The re-treatment will be performed at no charge to the Customer for labor or materials.
  4. The original 60-day Warranty Period does not restart or extend as a result of a re-treatment. All warranty coverage expires at the end of the original 60-day period.
  5. If the technician determines that the recurrence is due to an excluded condition (as described in Section 5), the technician will explain the findings and may provide a separate estimate for additional services, which would be at the Customer’s expense.
  6. A maximum of two (2) re-treatments will be provided under this Warranty during the 60-day period. If pest activity persists after two re-treatments, Organix Pest Control will work with the Customer to evaluate alternative solutions, which may be subject to additional charges.




7. LIMITATION OF LIABILITY

This Warranty is limited solely to the re-treatment services described herein. Organix Pest Control shall not be liable for any incidental, consequential, special, or punitive damages arising from or related to pest activity, including but not limited to: property damage, loss of use, loss of income, medical expenses, temporary housing costs, emotional distress, or any other damages whether direct or indirect.

The total liability of Organix Pest Control under this Warranty shall not exceed the amount paid by the Customer for the original pest control service that gave rise to the warranty claim.

This Warranty is provided in lieu of all other warranties, express or implied, including but not limited to any implied warranties of merchantability or fitness for a particular purpose, to the fullest extent permitted by applicable law.




8. TRANSFERABILITY

This Warranty is non-transferable and applies only to the original Customer at the original service address. If the property is sold, leased, or otherwise transferred to a new owner or occupant during the Warranty Period, this Warranty becomes void as of the date of transfer.




9. CANCELLATION

Organix Pest Control reserves the right to cancel this Warranty if:

  • The Customer fails to comply with the responsibilities outlined in Section 5.3
  • The Customer provides false or misleading information regarding the pest activity or property conditions
  • The Customer refuses to allow reasonable access for warranty inspections or re-treatments
  • Payment for the original service has not been received in full


In the event of cancellation, Organix Pest Control will provide written notice to the Customer explaining the reason for cancellation.



10. DISPUTE RESOLUTION

In the event of any dispute arising under this Warranty, both parties agree to first attempt to resolve the matter through good faith negotiation. If a resolution cannot be reached, the dispute shall be submitted to binding arbitration in accordance with the rules of the American Arbitration Association, conducted in the jurisdiction where the service was performed. Each party shall bear its own costs and attorneys’ fees in connection with any arbitration proceeding.




11. GOVERNING LAW

This Warranty shall be governed by and construed in accordance with the laws of the state in which the service was performed, without regard to conflict of law principles.



12. ENTIRE AGREEMENT

This Warranty, together with the service invoice and any written pre-treatment/post-treatment instructions provided at the time of service, constitutes the entire agreement between Organix Pest Control and the Customer regarding warranty coverage for the services rendered. No oral or written representations, promises, or agreements not expressly contained herein shall be binding upon either party.
